Thinking about the possibility of death or incapacity can make some people very uncomfortable, but doing so is a mark of maturity and concern for your family.

At Carolyn Moller Duncan, P.C., we help people think about these matters in a constructive way. We then create legal documents such as livings wills and powers of attorney that tell others what should be done if certain events occur.

These documents can provide you with peace of mind and the knowledge that your loved ones will be spared the burden of making difficult decisions about your life, health, and financial affairs.

The Value of a Living Will

A living will or advance medical directive describes what medical services should be provided or withheld under certain circumstances. In other words, it declares whether you want your life prolonged by artificial means should you be unable to make that decision yourself.

By making this decision when you are healthy and able, it can spare your family of the need to make these agonizing decisions. Attorney Carolyn Moller Duncan, can discuss this matter with you and draft a document in accordance with your wishes and values.

Powers of Attorney

There are two major types of powers of attorney:

Medical power of attorney — this names the person who is empowered to make decisions about your health care should you become incapacitated.

Financial power of attorney — this names someone who can make decisions about your financial affairs should you become incapacitated.

At Carolyn Moller Duncan, P.C., we remind our clients that powers of attorney are not only associated with death or medical disasters such as comas. Parents for example, can feel comfortable when they leave grandparents with a power of attorney delegating parental powers in case they are inaccessible at a time of a child’s need. Powers of attorney can be durable (permanent), or they can be for set periods of time. A springing power of attorney can be set up to become effective upon a certain event.

Carolyn Moller Duncan, P.C., an experienced estate planning law firm, has helped many people create wills, trusts, living wills, and powers of attorney that reflect their wishes and values.

Our firm can draft the documents that are right for you.
