Chapter 13 bankruptcy is available to most debtors.  It allows you to repay some debts discharge others, and modify some others.  Even if you qualify for a Chapter 7, you may want to file for broader opportunities under Chapter 13. To file a Chapter 13, you must have income because you will be required to repay some creditors for either three or five years.

Once your attorney files a Chapter 13 bankruptcy petition on your behalf, creditor actions against you must immediately stop. This is called an automatic stay and it means that creditors cannot call you and actions to repossess your car or to foreclose on your house must stop for a period of time.

Many people are concerned that they are going to lose their possessions, including their house or their car if they file for a Chapter 13 bankruptcy. Personal property is protected in Chapter 13 so you get to keep all your property.

Some possibilities in Chapter 13 are to discharge your 2nd or 3rd mortgage. “Cram down” the loan on your car, eliminate specific debt due to divorce and or renegotiate some other debts.
